What are the Junior Great Books Digital Classroom Terms of Service?

Terms of Service

The Great Books Foundation provides the Junior Great Books® Digital Classroom Service (the “Service”) to Licensees and their users through its online application, classroom.greatbooks.org, subject to the following Terms of Service. Whenever you access Junior Great Books Digital Classroom’s online application, you do so subject to the Terms of Service and all policies or procedures specifically incorporated herein by reference. 

Acceptance of Service

Your order and your use of the Junior Great Books Digital Classroom Service constitutes your acceptance of and your agreement to abide by these Terms of Service and all incorporated policies and procedures. Do not use the online application if you do not agree to the Terms of Service.

Description of Service

The Junior Great Books Digital Classroom Service is designed to allow users to access and read Junior Great Books digital materials and to make annotations, including highlights, pen notes, typed notes, and drawings. Student users can complete assignments and assessments and submit them to their teacher user(s). Teacher users can review completed assignments and assessments submitted to them by their student users. Teacher users can also track individual student time spent using materials. All users understand and agree that the Service (whether on a paid or free-trial basis) is provided as is. As the Service is a software-based service with ongoing updates based on user feedback and security updates, there may be problems of implementation or performance, commonly known as bugs. The Great Books Foundation and its Junior Great Books Digital Classroom software subcontractor strive to test, update, maintain, and optimize its system regularly so that the Service is delivered to users safely and effectively. Updates occur one day each month during the late evening hours. Licensees will be notified in advance of these updates.

Subscription Policies

Payment and Activation. Users wishing to access paid content on Junior Great Books Digital Classroom must create an account with Junior Great Books Digital Classroom and activate a subscription. For PayPal and credit card payments, the date of payment will be the Activation Date. For payments made by check or purchase order (“PO”), the Activation Date will usually occur within several business days of the Great Books Foundation’s receipt of an acceptable check or PO. The Activation Date may be delayed as the user and Great Books staff determine and carry out the implementation method. In addition, the Activation Date can be delayed at the request of the user.

Term, Termination, and Renewal. A paid subscription begins on the Activation Date and extends for 12 months (the “Term”). On the last day of the Term (the “Termination Date”), your subscription will end, unless you renew your subscription for an additional 12 months on or before the Termination Date. You understand that subscriptions do not automatically renew and that it is your responsibility to renew your subscription prior to the Termination Date.

Payment Options. The Great Books Foundation accepts online payment by Visa, Mastercard, American Express, and PayPal. Users wishing to pay for a subscription by check, PO, or other means must email customer.service@greatbooks.org or call 1-800-222-5870.

Billing Security. The Great Books Foundation uses Secure Sockets Layer technology that sends credit card data in encrypted code. We do not keep a record of or have access to your credit card number. 

Passwords. Your Junior Great Books Digital Classroom username and password give you access to your subscription when you create your account using an access code, when your school or district creates your account on your behalf, or when you create your account through clicking on an integration or single sign-on link. Please take appropriate measures to keep your password confidential, and do not share it with third parties. If your password is disclosed, please log in and reset your password.

Implementation Methods. The default method for issuing licenses is through access codes. For larger implementations, a school or district and the Great Books Foundation can agree to directly integrate the school’s/district’s accounts and rosters with the third-party platforms ClassLink or Clever. In addition, we can agree to integrate with a school or district’s online learning platform, including Blackboard, Brightspace, Canvas, Google Classroom, Microsoft Teams, Moodle, OneRoster, or Schoology, among others, using a third-party integration platform called Edlink.

Data Privacy Policy

Account data and certain other information about you are subject to our Data Privacy Policy. The Great Books Foundation and its Junior Great Books Digital Classroom software subcontractor take data privacy seriously. We shall comply with all US federal laws and regulations pertaining to data privacy and security, including FERPA, COPPA, and PPRA, as they relate to the collection, use, storage, and sharing of all user data and specifically student data. The Great Books Foundation and its Junior Great Books Digital Classroom software subcontractor agree to abide by and maintain adequate data security measures, consistent with standards and best practices within the educational technology industry, and to protect all user data, including student data, from unauthorized disclosure or acquisition by an unauthorized person. These measures include but are not limited to:

  • Passwords and Employee Access. We shall secure usernames, passwords, and any other means of gaining access to the Service or user data, including student data. We shall only provide access to student data to Great Books or Junior Great Books Digital Classroom software subcontractor employees who are performing the Service.
  • Security Protocols. We shall maintain security protocols that meet industry standards while the data is in transfer and storage, ensuring that data may only be viewed or accessed by parties legally allowed to do so. We shall maintain all data obtained or generated in a secure digital environment and not copy, reproduce, or transmit data, except as necessary to fulfill the purpose of delivery of the Service. 
  • Security Technology. We shall employ internet industry standard measures to protect data from unauthorized access while the data is in transfer and storage. The service security measures shall include firewall, server authentication, data encryption, and password protection.

Data Ownership

Student Data. All student data transmitted to Junior Great Books Digital Classroom is the property of the student. Parent Access. A parent, legal guardian, or student may request the opportunity to inspect and review student data in the student’s records and may seek to amend student data that is inaccurate, misleading, or in violation of the student’s right to privacy. We will respond in a timely manner (and no later than 45 days from the date of the request) to a Licensee’s request for student data in a student’s records held by Junior Great Books Digital Classroom to view or correct as necessary. In the event that a parent of a student or other individual contacts the Great Books Foundation to review any of the student data accessed pursuant to Junior Great Books Digital Classroom, we shall refer the parent or individual to the Licensee, who will follow the necessary and proper procedures regarding the requested information.

Third-Party Requests. Should a third party, including any law enforcement or government entity, request data held by Junior Great Books Digital Classroom pursuant to the Terms of Service, we shall redirect the third party to request the data directly from the Licensee. We shall notify the Licensee in advance of a compelled disclosure to a third party. We shall share user data with law enforcement if required by law or court order.

Disposition of Data. Upon written request, we shall dispose of or delete all data obtained under these Terms of Service when it is no longer needed for the purpose for which it was obtained. Upon receipt of a request from a Licensee, we shall delete user data within 10 calendar days. We may also delete all data obtained during delivery of Junior Great Books Digital Classroom when the Licensee does not renew their subscription and the Termination Date has passed. 

Junior Great Books Digital Classroom Proprietary Rights

You acknowledge and agree that the Service and all necessary software used in connection with the Service contain proprietary and confidential information that is protected by applicable intellectual property and other laws. You further acknowledge and agree that information presented to you through the Junior Great Books Digital Classroom online application is protected by copyrights, trademarks, service marks, or other proprietary rights and laws. Except as expressly authorized by the Great Books Foundation, you agree not to modify, rent, lease, loan, sell, distribute, or create derivative works based on the Service, in whole or in part.

You also agree not to reproduce, duplicate, copy, sell, resell, or exploit for any commercial purposes any portion of the Junior Great Books Digital Classroom online application.

Grant of Limited License. The Great Books Foundation grants you, the Licensee, and your users, a personal, nonexclusive, and nontransferable license to use the Service. You agree that you will not copy, modify, create a derivative work of, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicense, grant a security interest in, or otherwise transfer any right in the Service. You agree not to modify the software in any manner or form, or to use modified versions of the software, including (without limitation) for the purpose of obtaining unauthorized access to the Service. You agree not to access the Service by any means other than through the interface that is provided by the Great Books Foundation for use in accessing the Service.

Restrictions of Use. You understand that the Junior Great Books Digital Classroom Service and software are wholly owned by the Great Books Foundation and/or its software subcontractor and are protected by copyright and other laws in the United States and elsewhere. As a Licensee, you are permitted use of the Service for the number of users subscribed; there is no transfer of ownership or copyright. You agree that this license grant does not include the rights of modification, manufacture, distribution, sale, or sublicense. The Great Books Foundation reserves the right to cancel your license or subscription without refund if it is determined that you have violated this portion of the Terms of Service.

Copyright Violation Notice

The Great Books Foundation respects the intellectual property of others, and we ask our subscribers to do the same. If any copyright owner believes that there is any intellectual property infringement on Junior Great Books materials displayed in Junior Great Books Digital Classroom, please contact us at customer.service@greatbooks.org, and we will investigate. 

Indemnity

You agree to indemnify and hold the Great Books Foundation, its parent, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of any content you submit, post, transmit, or make available through the Junior Great Books Digital Classroom online application, your use of the Service, your connection to the Service, your violation of the Terms of Service, or your violation of any rights of another.

To the fullest extent allowed by law, the Great Books Foundation shall defend, indemnify, and hold harmless you, your directors, officers, agents, employees, and guests against any claim or demand arising from any actual or alleged act, error, or omission by Junior Great Books Digital Classroom or its directors, officers, agents, employees, volunteers, or guests arising from Junior Great Books Digital Classroom’s duties and obligations described in this agreement or imposed by law.
